1. Acceptance of These Terms
These Terms and Conditions (the "Terms") govern access to and use of Fountain 0 Watch, including watch.fountain0.com, user accounts, films, audiovisual works, rental and purchase functionality, streaming features, and related services (collectively, the "Service"). The Service is operated by Fountain 0 Inc., a Delaware corporation ("Fountain 0," "we," "us," or "our").
You accept these Terms when you create a Fountain 0 Watch account and select the account-registration control confirming your agreement. The registration page will state substantially: "By creating an account, you agree to Fountain 0's Terms and Conditions and acknowledge its Privacy Policy." The Terms and Privacy Policy will be available through links presented during registration.
Your acceptance applies to your account, all purchases made through that account, and all use of the Service unless Fountain 0 expressly presents additional terms for a specific product, promotion, or feature. The checkout process completes a transaction under these Terms and does not require a separate acceptance of these Terms.
We may maintain records reasonably designed to demonstrate acceptance, including the Terms version, date and time, account identifier, and relevant device, browser, network, and IP information. If you do not agree to these Terms, do not create an account or use the Service.
IMPORTANT: Sections 28 through 30 contain an agreement to resolve most disputes through individual binding arbitration, a class-action waiver, and a jury-trial waiver. Please read those sections carefully.
2. Eligibility and Authority
You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase access through the Service. A minor may use the Service only through an account created and supervised by a parent or legal guardian who accepts these Terms and is responsible for the minor's use.
By creating an account or using the Service, you represent that you have legal capacity to enter into these Terms, that the information you provide is accurate and complete, and that you are not prohibited from using the Service under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, although consumer rentals remain limited to private, non-commercial viewing unless Fountain 0 agrees otherwise in writing.
3. Accounts and Account Security
Certain features require an account. Your account is personal to you. You may not sell, transfer, sublicense, or commercially share your account, login credentials, purchase rights, or viewing entitlements.
You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account, except to the extent applicable law provides otherwise. You must promptly notify us at support@fountain0.com if you suspect unauthorized access, credential compromise, or fraudulent use.
You must provide accurate, current account information and keep it updated. We may require email, telephone, identity, payment, location, device, or security verification. We may require reauthentication, reset sessions, restrict devices, or suspend an account when reasonably necessary to protect users, rights holders, payment systems, or the Service.
Authentication may be provided by third-party services. Their services may be governed by their own terms and privacy notices, but your use of Fountain 0 Watch remains subject to these Terms.
4. Description of the Service
Fountain 0 Watch provides access to films and other audiovisual content through rentals, limited viewing windows, promotional access, or other models displayed through the Service. Each title page or checkout page will identify the material commercial terms of the transaction, such as the title, price, currency, access period, and any material territorial or technical restriction.
The Service does not transfer ownership of any film, recording, digital file, or intellectual property. A completed transaction grants only the limited streaming license described in these Terms.
We may add, remove, reclassify, or modify titles, trailers, artwork, metadata, subtitles, captions, languages, features, and technical delivery methods. If a paid entitlement is active, we will address a material withdrawal of access as described in Section 18 and as required by applicable law.
5. Limited Digital Content License
After a successful purchase, Fountain 0 grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to stream the applicable content through the Service, on supported devices, solely for private and non-commercial viewing, in an authorized territory, and only during the access period displayed for the transaction.
Unless Fountain 0 gives prior written permission, you may not download, copy, reproduce, record, photograph, capture, retransmit, broadcast, distribute, sell, rent, sublicense, publicly perform, publicly exhibit, or commercially exploit any content. You may not use purchased access for a theater, school, university, hotel, business, festival, club, association, conference, ticketed event, public gathering, institutional program, or group screening outside an ordinary private household.
You may not share playback links, access tokens, authorization data, or credentials; remove or alter notices, watermarks, or identifiers; circumvent encryption, territorial controls, concurrency limits, device limits, or digital rights management; use stream-ripping, screen-recording, scraping, automated capture, or similar tools; or reverse engineer, decompile, disassemble, probe, or interfere with the Service.
You may not use Service content, stills, audio, metadata, subtitles, scripts, or other materials to train, fine-tune, benchmark, test, evaluate, or develop an artificial-intelligence or machine-learning model without Fountain 0's prior written authorization. All rights not expressly granted are reserved.
6. Prices, Payments, and Taxes
Prices and currencies are displayed before purchase and may vary by title, territory, access model, or promotion. By selecting the purchase control, you authorize Fountain 0 and its payment processor to charge the displayed amount, together with applicable taxes and other charges disclosed before payment, to the payment method you provide.
You represent that you are authorized to use the payment method and that the transaction information is accurate. Payment processing may be provided by a third party. Fountain 0 does not necessarily receive or store complete payment-card details.
A transaction is completed when payment is successfully authorized and the corresponding digital entitlement is issued to your account. If payment authorization fails, is reversed, is identified as fraudulent, or remains incomplete, Fountain 0 may decline or revoke the entitlement.
You are responsible for applicable transaction taxes, duties, and government charges, except taxes measured by Fountain 0's net income. Promotional prices, credits, and offers may have separate conditions and may be modified or withdrawn before purchase.
7. Immediate Activation and Access Periods
Unless the transaction page expressly states otherwise, a rental or limited-access period begins immediately after successful payment when the viewing entitlement is activated and made available through your account. The period does not begin when you first press play.
The access period runs continuously from activation. It does not pause or restart because you have not begun watching, are logged out, pause or stop playback, change devices or locations, lose internet access, turn off a device, experience a personal scheduling conflict, or fail to finish the content before expiration.
You are responsible for confirming the access period and watching before it expires. Expiration of unused or partially used access does not create a right to a refund, extension, replacement, or credit, except where mandatory law requires otherwise or Fountain 0 expressly approves a remedy.
Digital delivery is considered to have begun when the entitlement is activated or the content is otherwise made available through your account, whether or not you choose to stream it. Your purchase instructs Fountain 0 to provide that access immediately.
8. Refund Policy - Final Digital Purchases
Except where mandatory law requires otherwise, all purchases are final and non-refundable once access to the purchased digital content has been activated or made available through the purchaser's account.
A refund, credit, replacement, or extension will not ordinarily be provided because a user changed their mind; made an accidental purchase; selected the wrong title; did not begin or complete playback; forgot about the purchase; allowed the access period to expire; lacked time to watch; or did not use all available access.
A refund will also not ordinarily be provided because of subjective dissatisfaction with a film, including disagreement with or objection to its story, themes, subject matter, politics, viewpoints, genre, pacing, runtime, tone, performances, visual style, sound, production methods, artistic choices, technology, or use of artificial intelligence, machine learning, synthetic media, computer-generated imagery, virtual production, or digital effects.
Differences between a viewer's expectations and the content supplied do not establish non-delivery or defect where the title and access were provided substantially as described. Trailers, stills, synopses, reviews, ratings, classifications, awards, festival selections, promotional statements, and metadata are informational and do not guarantee that a user will enjoy or approve of the content.
This policy does not exclude remedies for verified duplicate charges, unauthorized transactions, complete non-delivery, or other rights that cannot lawfully be waived. Any exception is governed by Sections 9 and 10 and by applicable law.
9. Technical Problems and Limited Remedies
If a technical failure within systems reasonably controlled by Fountain 0 materially prevents access to purchased content during substantially all of the access period, contact support@fountain0.com promptly. You must provide information reasonably needed to investigate, which may include the account email, transaction details, title, date and time, device, operating system, browser, error messages, screenshots, and troubleshooting steps.
After investigation, Fountain 0 may restore access, extend the access period, issue replacement access, provide a service credit, or issue a refund. Except where law requires a specific remedy, Fountain 0 may select the remedy reasonably suited to the circumstances.
A short interruption, temporary buffering, brief degradation, planned maintenance, isolated playback error, or issue reasonably resolved through ordinary troubleshooting does not automatically qualify for a refund. Problems caused by a user's device, browser, operating system, internet provider, bandwidth, network, firewall, VPN, proxy, casting equipment, audio or display system, data allowance, electricity, location, or third-party software are not failures within Fountain 0's reasonable control.
If a verified system or processor error creates a duplicate charge for the same entitlement, Fountain 0 may refund the duplicate charge. Separate purchases knowingly made through different accounts, sessions, or payment methods are not duplicate charges merely because they concern the same title.
10. Unauthorized Transactions, Refund Requests, and Chargebacks
If you believe a transaction was unauthorized, contact Fountain 0 and your payment provider promptly. We may investigate account activity, payment records, login records, entitlement creation, playback activity, device information, IP information, communications, and other relevant security data.
Before initiating a chargeback or payment dispute concerning service quality, delivery, cancellation, or a refund, you agree to contact support@fountain0.com and provide Fountain 0 a reasonable opportunity to investigate and respond. This requirement does not prevent you from exercising a non-waivable right under applicable law.
A chargeback is not a substitute for this Refund Policy. Fountain 0 may contest disputes involving authorized purchases, access made available as described, expired access periods, failure to watch, subjective dissatisfaction, accidental purchases, misuse of credentials, or other circumstances that do not establish a valid payment claim.
Acceptance of these Terms during account registration forms part of the transaction record. We may provide the payment processor, card network, issuing bank, fraud-prevention provider, or dispute administrator with relevant evidence, including the accepted Terms version, purchase receipt, account details, entitlement records, login information, playback information, device and IP data, technical logs, and support communications.
False unauthorized-payment reports, fraudulent refund requests, or abusive chargebacks may result in suspension or termination of the account, cancellation of active entitlements, refusal of future purchases, and referral to payment providers or authorities where appropriate.
11. Content Information and Viewer Discretion
Films available through the Service may contain mature, disturbing, controversial, political, historical, violent, sexual, emotional, religious, cultural, experimental, fictional, or otherwise sensitive material. Content descriptions, ratings, classifications, advisories, trailers, stills, and metadata may not identify every element a viewer considers sensitive or objectionable.
You are responsible for deciding whether content is appropriate for you and for any minor or other person permitted to view through your account. Fountain 0 does not guarantee that a title will match personal values, expectations, tastes, sensitivities, or preferences.
The availability of a title does not mean that Fountain 0 endorses every statement, viewpoint, character, action, event, or opinion depicted. Fictional and dramatized material may not represent actual people or events. Where a title addresses real events, historical subjects, politics, culture, or public controversy, the work may reflect creative interpretation.
Nothing in these Terms prevents a user from posting an honest review or expressing a lawful opinion about the Service or its content. Users may not, however, make unlawful threats, infringe rights, disclose confidential security information, or falsely represent that they speak for Fountain 0.
12. Artificial Intelligence and Other Production Methods
Content offered through the Service may contain images, voices, sounds, performances, characters, environments, visual elements, editing, or other components created, generated, modified, enhanced, or assisted using artificial intelligence, machine learning, synthetic media, digital synthesis, computer-generated imagery, visual effects, virtual production, or other emerging technologies.
Any production description supplied by Fountain 0 is general informational material unless expressly identified as a binding specification. It does not create a warranty concerning the precise tools, models, prompts, workflows, percentages, degree of human involvement, degree of machine involvement, or method used for each image, sound, sequence, performance, or production stage.
A viewer's objection to or later discovery of a production method does not by itself establish a defect, non-delivery, misrepresentation, or refund entitlement, provided that Fountain 0 did not make a materially false statement concerning the title.
13. Technical Requirements and Streaming Quality
You are responsible for obtaining and maintaining a compatible device, supported and updated browser or application, reliable broadband connection, sufficient bandwidth and data allowance, functioning audio and video equipment, current operating-system and security updates, and all telecommunications, electricity, and other services needed to use the Service.
Streaming quality may vary based on device capabilities, display resolution, audio equipment, internet speed, network congestion, routing, geographical location, browser configuration, casting technology, and other factors. The highest advertised resolution or audio format is not guaranteed on every device or connection.
We do not guarantee support for every browser, operating system, smart television, mobile device, casting device, accessibility tool, network, VPN, proxy, display, or configuration. We may update technical requirements and discontinue support for outdated or insecure systems.
Use of VPNs, proxies, anonymization services, location-spoofing tools, or similar systems may interfere with payment verification, territorial licensing, fraud prevention, or playback and may result in restricted access.
14. Geographic and Licensing Restrictions
Content availability may differ by country, state, territory, or location due to distribution rights, licensing, legal requirements, taxes, sanctions, classification, or technical constraints. You may access content only from a territory in which Fountain 0 has authorized it.
You may not conceal, manipulate, or misrepresent your location to access a title that is unavailable in your territory. We may use account information, payment information, IP addresses, device data, and other signals to determine or verify geographic eligibility.
Traveling after purchase may affect access if the destination is not an authorized territory. Fountain 0 does not guarantee that content purchased in one country will remain accessible from another country, except where applicable law requires otherwise.
15. Devices, Sessions, and Account Sharing
Fountain 0 may limit the number of simultaneous streams, active sessions, authorized devices, locations, playback attempts, or account changes associated with an account or entitlement. Limits may vary by title or security risk and may be enforced through authentication, playback tokens, device identifiers, or other controls.
Unless otherwise stated, access is intended for the account holder and ordinary private viewing within the account holder's household. Commercial sharing, credential resale, widespread distribution of credentials, public credential posting, or repeated use by unrelated persons is prohibited.
We may require reauthentication, terminate sessions, revoke playback tokens, remove devices, or temporarily restrict access when activity appears excessive, automated, fraudulent, geographically inconsistent, or otherwise unauthorized.
16. Prohibited Conduct
You may not use the Service to violate law, regulation, court order, sanctions, or third-party rights; infringe copyright, trademark, privacy, publicity, contract, or other rights; impersonate another person; misrepresent your identity or location; access another user's account; commit payment fraud; or obtain content through unauthorized means.
You may not introduce malware or harmful code; use bots, crawlers, scrapers, automated requests, denial-of-service activity, or other systems that burden or disrupt the Service; probe or test vulnerabilities without written authorization; bypass rate limits or access controls; manipulate purchase, entitlement, playback, or engagement records; or interfere with another user's access.
You may not use the Service or content for public exhibition, commercial exploitation, institutional distribution, advertising, endorsement, unlawful content, or any purpose outside the license granted in Section 5. You may not assist or encourage another person to engage in prohibited conduct.
17. Intellectual Property
The Service and its software, interfaces, designs, logos, trademarks, trade dress, text, metadata, artwork, posters, stills, trailers, films, audio, subtitles, captions, graphics, and other materials are owned by or licensed to Fountain 0 and are protected by copyright, trademark, trade secret, and other laws.
Fountain 0, Fountain 0 Watch, related logos, and associated source identifiers are trademarks or trade dress of Fountain 0 or its licensors. No provision of these Terms transfers ownership or grants an implied license to any intellectual property.
Except as permitted by law, you may not use Fountain 0's names, marks, artwork, stills, trailers, clips, metadata, or promotional materials without prior written permission. Any authorized use must comply with the scope and conditions of the permission given.
18. Content Availability and Service Changes
We aim to provide reliable access but do not guarantee that the Service will always be uninterrupted, error-free, secure, or available from every location or device. Maintenance, upgrades, security incidents, infrastructure failures, third-party outages, licensing restrictions, legal requirements, or circumstances beyond reasonable control may affect availability.
We may modify the Service's interface, architecture, security measures, supported devices, catalog, and features. We may also remove or replace content when rights expire, legal concerns arise, or operational needs change.
If Fountain 0 permanently withdraws a purchased title before an active paid access period ends and cannot provide substantially equivalent access, we may restore access, provide replacement access, extend the period, issue a credit, or issue a refund as appropriate and as required by law. Temporary unavailability is addressed under Section 9.
19. Third-Party Services
The Service relies on third-party providers for functions that may include account authentication, identity management, payment processing, hosting, databases, video encoding, streaming, content delivery, analytics, communications, customer support, security, and fraud prevention.
Third-party services may be governed by separate terms and privacy notices. Fountain 0 is not responsible for a third party's independent services, systems, availability, acts, omissions, or policies except to the extent responsibility cannot lawfully be excluded.
Links to third-party websites or services are provided for convenience and do not constitute endorsement, warranty, or control. You are responsible for reviewing applicable third-party terms before using those services.
20. Privacy
Fountain 0's collection, use, disclosure, retention, and protection of personal information are described in the Fountain 0 Watch Privacy Policy. The Privacy Policy is incorporated by reference for purposes of explaining our data practices, but it does not expand contractual rights beyond applicable law.
By using the Service, you acknowledge that information may be processed by service providers supporting authentication, payments, databases, hosting, video delivery, security, analytics, communications, and fraud prevention, including providers operating in other jurisdictions as described in the Privacy Policy.
21. Copyright and Rights Complaints
A person who believes material available through the Service infringes a copyright or other right may send a notice to Fountain 0 at info@fountain0.com and 5551 Hollywood Blvd #1339, Los Angeles, CA 90028, United States. The notice should identify the protected work or right, identify the material at issue and its location, provide contact information, explain the basis of the complaint, and include any statements and signature required by applicable law.
We may remove or restrict material, preserve evidence, notify relevant parties, and take action against repeat infringers where appropriate. Submitting a knowingly false complaint may create legal liability. This section does not constitute a representation that Fountain 0 has appointed or registered a particular statutory agent unless separately confirmed in an official filing.
22. Suspension and Termination
We may suspend, restrict, or terminate an account or entitlement when we reasonably believe the user violated these Terms; compromised security; engaged in fraud, chargeback abuse, infringement, copying, redistribution, or circumvention; created legal, payment, or operational risk; or when action is required by law, a payment provider, or a rights holder.
Where reasonably practical and legally permitted, we may provide notice and an opportunity to contact support. Immediate action may be taken where necessary to prevent harm, preserve evidence, protect content, or comply with law.
Termination for breach may result in loss of unused access or account privileges, except where prohibited by law. Provisions that by their nature should survive will survive, including payment obligations, intellectual property, disclaimers, liability limitations, indemnification, evidence and records provisions, dispute resolution, and governing law.
23. Electronic Communications
You consent to receive account, transaction, security, support, policy, and legal communications electronically, including by email, account notification, or posting through the Service. Electronic notices satisfy any legal requirement that communications be in writing, to the extent permitted by law.
You are responsible for maintaining a valid email address, reviewing messages sent to it, and keeping contact information current. Marketing communications, where used, will be governed by applicable law and available preference controls.
24. Feedback
If you voluntarily submit suggestions, concepts, ideas, feedback, or recommendations about the Service, you grant Fountain 0 a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, reproduce, modify, commercialize, and incorporate that feedback without restriction or compensation.
This provision does not transfer ownership of independently created copyrighted material submitted for a purpose other than feedback and does not authorize Fountain 0 to use personal information contrary to the Privacy Policy.
25. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." FOUNTAIN 0 DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, COMPATIBILITY, SECURITY, UNINTERRUPTED OPERATION, AND FREEDOM FROM HARMFUL COMPONENTS.
Fountain 0 does not warrant that the Service will satisfy subjective expectations; that content will be enjoyable, suitable, accurate, complete, or free from material a viewer considers objectionable; that every device, browser, network, or territory will be supported; that descriptions, advisories, ratings, captions, subtitles, or promotional materials will identify every content characteristic; or that all interruptions and errors will be corrected immediately.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent permitted by law. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
26. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FOUNTAIN 0 AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, PRODUCERS, DISTRIBUTORS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, USE, OR REPUTATION, ARISING FROM OR RELATED TO THE SERVICE, CONTENT, A TRANSACTION, UNAUTHORIZED ACCOUNT ACCESS, INTERRUPTION, TECHNICAL FAILURE, THIRD-PARTY SERVICES, SUSPENSION, TERMINATION, OR EXPIRATION OF ACCESS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF FOUNTAIN 0 AND THE OTHER PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING FROM OR RELATING TO A SPECIFIC TRANSACTION WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THAT TRANSACTION OR FIFTY UNITED STATES DOLLARS. FOR CLAIMS NOT TIED TO A SPECIFIC TRANSACTION, AGGREGATE LIABILITY WILL NOT EXCEED FIFTY UNITED STATES DOLLARS.
These limitations apply regardless of legal theory and even if a remedy fails of its essential purpose. Nothing excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct where non-waivable, or personal injury caused by negligence where applicable law prohibits limitation.
27. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Fountain 0 and its directors, officers, employees, affiliates, contractors, producers, distributors, licensors, service providers, and agents from claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the Service; violation of these Terms; infringement of another person's rights; recording, copying, distribution, exhibition, or misuse of content; fraudulent conduct; payment or chargeback abuse; or activity conducted through your account.
This obligation does not apply to the extent a claim results from Fountain 0's own unlawful conduct or where indemnification is prohibited by applicable law. Fountain 0 may control the defense and settlement of an indemnified claim, provided it does not settle a claim imposing a personal admission or non-monetary obligation on you without your consent.
28. Informal Dispute Resolution
Before starting arbitration or litigation, the party raising a dispute must send a written notice describing the dispute and requested relief. A notice from a user must include the user's full name, account email, relevant transaction or title, a factual description, requested resolution, and supporting information reasonably needed to evaluate the matter.
Notices to Fountain 0 must be sent to Fountain 0 Inc., 5551 Hollywood Blvd #1339, Los Angeles, CA 90028, United States, and info@fountain0.com. Notices from Fountain 0 will be sent to the email associated with the account or another valid address provided by the user.
The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of a complete notice. Any applicable limitations period will be suspended during that period to the extent permitted by law. Either party may seek urgent temporary relief when necessary to prevent immediate harm, preserve evidence, or protect intellectual property or security.
29. Binding Individual Arbitration
Except for claims described below or claims that applicable law prohibits from being arbitrated, any dispute, claim, or controversy arising from or relating to the Service, content, an account, a transaction, these Terms, or the relationship between you and Fountain 0 will be resolved through individual binding arbitration rather than in court.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, as modified by these Terms. If the American Arbitration Association is unavailable or unwilling to administer a matter, the parties will select another nationally recognized arbitration administrator or a court may appoint one as permitted by law.
The arbitrator has authority to decide issues concerning interpretation, applicability, enforceability, and formation of this arbitration agreement, except that a court will decide any issue concerning the enforceability of the class-action waiver in Section 30. The arbitrator may award relief available to an individual claimant in court, subject to applicable law and lawful limitations in these Terms.
Arbitration may occur through documents, telephone, videoconference, or an in-person hearing as permitted by the applicable rules. Fountain 0 will pay fees where required by the administrator's consumer rules or applicable law. Each party will otherwise bear its own attorneys' fees unless a statute or arbitrator permits an award.
Either party may bring an individual action in small claims court if the claim qualifies and remains individual. Either party may seek court relief to protect intellectual property, confidential information, content security, payment systems, or access controls. A user may report a matter to a government agency, and an agency may pursue relief within its authority.
You may opt out of this arbitration agreement by sending a written notice to info@fountain0.com within 30 days after first accepting these Terms. The notice must include your full name, account email, and a clear statement that you opt out of the arbitration agreement in the Fountain 0 Watch Terms and Conditions. Opting out does not affect the remaining Terms.
30. Class-Action and Jury-Trial Waivers
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FOUNTAIN 0 AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, MASS, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING.
Unless both parties agree in writing, an arbitrator may not consolidate claims of more than one person or preside over a class, collective, mass, or representative proceeding. If a final decision holds that applicable law prevents enforcement of this waiver for a particular claim or remedy, that claim or remedy will proceed in court after arbitrable matters are completed, unless law requires a different sequence.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FOUNTAIN 0 KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE ARISING FROM OR RELATING TO THE SERVICE, A TRANSACTION, OR THESE TERMS.
31. Governing Law and Forum
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement.
For a dispute not subject to arbitration, you and Fountain 0 consent to the exclusive jurisdiction of the state and federal courts located in Delaware, except where applicable consumer law provides a non-waivable right to bring a proceeding elsewhere.
Nothing in these Terms deprives a consumer of mandatory protections provided by the law of the consumer's place of residence. Where a mandatory rule conflicts with these Terms, that rule controls only to the extent of the conflict.
32. International Users
The Service is operated from the United States. Users outside the United States are responsible for compliance with applicable local law. Content, payment methods, features, and remedies may vary by territory.
These Terms do not exclude, restrict, or waive statutory consumer rights that cannot lawfully be excluded. References to final purchases, warranty disclaimers, liability limitations, arbitration, governing law, or forum apply only to the extent permitted in the user's jurisdiction.
33. Sanctions and Export Compliance
You may not use the Service where doing so would violate applicable sanctions, export controls, trade restrictions, or other law. You represent that you are not a prohibited or restricted person under applicable United States law and are not using the Service for a prohibited destination, person, or purpose.
We may block transactions, restrict access, request verification, or preserve records where reasonably necessary to comply with legal obligations or provider requirements.
34. Changes to These Terms
We may update these Terms to reflect changes in law, technology, business practices, content offerings, security, payment arrangements, service providers, or Service functionality. Updated Terms will be posted through the Service with a revised Last Updated date.
Where required by law, we will provide additional notice or request renewed consent. Changes apply prospectively from their effective date and will not retroactively alter a completed transaction in a manner prohibited by law.
Continued use of the Service after updated Terms take effect constitutes acceptance where applicable law permits acceptance through continued use. If affirmative acceptance is required, we may require it before further access or purchases.
35. Assignment
You may not assign or transfer your account, purchases, licenses, rights, or obligations under these Terms without Fountain 0's written consent.
Fountain 0 may assign these Terms or transfer rights and obligations in connection with a merger, financing, acquisition, restructuring, corporate reorganization, sale of assets, or transfer of the Service, subject to applicable law.
36. Severability, Waiver, and Interpretation
If a provision of these Terms is held invalid, illegal, or unenforceable, it will be enforced to the greatest extent permitted or modified to reflect its intended purpose, and the remaining provisions will continue in effect. The specific rules in Sections 29 and 30 govern severability of arbitration and class-waiver provisions.
A failure or delay by Fountain 0 in exercising a right does not waive that right. A waiver is effective only if in writing and signed by an authorized Fountain 0 representative.
Headings are for convenience and do not limit interpretation. "Including" means "including without limitation." The singular includes the plural where context permits. These Terms will not be construed against a party merely because that party drafted them.
37. Entire Agreement and Contact Information
These Terms, the Privacy Policy, the material transaction information displayed before purchase, and any additional terms expressly applicable to a particular feature or promotion form the entire agreement between you and Fountain 0 concerning the Service and supersede prior or contemporaneous communications on the same subject.
If transaction-specific information displayed before purchase conflicts with these Terms, that information controls solely for that transaction. If a promotion or feature has additional written terms, those additional terms control only to the extent of a direct conflict concerning that promotion or feature.
